About these terms

SGO FRF Files (the site, we, us) is an online shop for SGO, FRF and SOX flash files used with ODIS Engineering, ODIS Service and VAS-PC. These terms are the agreement between you and us for your use of the site and for every file you buy from it.

By creating an account, placing an order or otherwise using the site you accept these terms. If you do not agree with them, please do not use the site.

If you buy on behalf of a business, you confirm that you are authorised to bind that business, and these terms then bind the business as well.

SGO FRF Files is part of AHDev (Pty) Ltd, a company registered in South Africa. Your contract for any purchase is with AHDev (Pty) Ltd.

Your account

You need an account to buy files. Every purchase is linked to your account so that you can download the file again later.

You must be at least 18 years old, or the age of majority where you live, to open an account. Give us accurate details and keep them up to date on your profile page. Keep your password secret: you are responsible for everything done through your account until you tell us that it has been compromised.

We may suspend or close an account that is used for fraud, for payment disputes raised without contacting us first, for sharing or reselling files, for automated access, or for any other breach of these terms.

You can delete your account at any time from your profile page. Records of paid orders are kept afterwards, as described in our Privacy Policy.

The files we sell

Each listing is an original flash container as supplied for ODIS Engineering (SGO), ODIS Service (FRF) or VAS-PC (SOX), identified by the software part number, software version and component in its file name. We do not modify the files.

The control unit, vehicle and model year information on a listing is decoded from the part number and is a guide only, because parts are shared across models. Before you buy, compare the software part number, version and component on the listing with what ODIS or VCDS reports for your control unit. Choosing the right file is your responsibility.

To use a file you need your own licensed copy of the matching diagnostic software and a compatible diagnostic interface. We do not supply, license or support ODIS, VAS-PC, VCDS or any interface, and we do not provide flashing instructions, coding or diagnostic services.

We may add, change, withdraw or reprice files at any time. Prices are shown in US dollars.

Orders and payment

Clicking Buy now creates a pending order in your account. No money is taken until you pay it. You can delete a pending order from My Orders at any time, and we may remove orders that stay unpaid.

Payments are taken by Stripe (card, Apple Pay, Google Pay and Link) or by PayFast (card or instant EFT) on their own secure pages. Card details never touch this site. The price shown is the price you pay us; your bank or card issuer may add its own currency conversion or transaction fees, which are outside our control.

Your order is accepted, and the contract for the file is made, when the payment provider confirms your payment to us. If the price shown was clearly wrong, we suspect fraud, or the file can no longer be supplied, we may cancel the order and refund whatever you paid.

Delivery and downloads

Files are delivered as downloads only. As soon as your payment is confirmed, the file can be downloaded from the order page in your account, and we email you a confirmation with a link to it. Nothing is posted or shipped.

Purchased files stay available in your account so that you can come back for them. If a file you bought becomes unavailable, contact us and we will supply it another way or refund that purchase.

Because delivery starts the moment your payment is confirmed, you agree that we begin delivery immediately and you acknowledge that you lose any statutory right to cancel or withdraw from the order once the download is available. Our Refund Policy sets out the cases in which we do refund.

What you may do with a file

Buying a file gives you a copy of it for your own use in programming control units that you own or are authorised to work on. You may keep a backup copy.

You may not sell, rent, lend, share, publish or otherwise redistribute a file, make it available to anyone else, or use the site or its files to build a competing catalogue.

The software inside a file is the copyrighted work of its manufacturer. Your purchase transfers no intellectual property rights to you.

Use at your own risk

Files are purchased and used entirely at your own risk. SGO FRF Files accepts no responsibility for any damage to control units, vehicles or data resulting from their use. Always back up the software currently on your control unit before installing or flashing a new file.

Flashing a control unit can leave it inoperable if the wrong file is used, the power supply drops, the interface disconnects or the procedure is interrupted. You are responsible for choosing the right file, for using suitable and up-to-date tools with a stable power supply, and for the outcome of the flash.

You are also responsible for making sure that programming the control unit is lawful where you are and does not breach type approval or emissions rules, insurance conditions or a manufacturer warranty.

Warranties and liability

Files are provided as they are supplied to us. Except as set out in our Refund Policy, and to the extent the law allows, we give no warranty that a file is suitable for your control unit or vehicle, will fix a fault, or is free of errors.

To the extent the law allows, our total liability to you in connection with an order is limited to the amount you paid for that order, and we are not liable for any indirect or consequential loss, such as damage to a control unit or vehicle, lost data, loss of use or lost profit.

Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for fraud, or takes away rights you have under the Consumer Protection Act of South Africa or the consumer laws of the country you live in.

Refunds

Because every file is a download delivered instantly, purchases cannot be returned and are refunded only in the cases set out in our Refund Policy. Please read it before you buy.

Acceptable use

You may not scrape, crawl or copy the catalogue, use automated tools to create accounts, place orders or download files, probe or interfere with the site or its security, or try to reach files other than through a paid order in your own account. The account forms and the checkout are rate limited and protected against bots, and we may block traffic or close accounts that breach this section.

Intellectual property and trademarks

The site, its design, its catalogue data and its logo belong to AHDev (Pty) Ltd and may not be copied without permission.

ODIS, VAS-PC, VCDS and the vehicle brand names used on the site are trademarks of their owners and are used only to identify which files fit which control units. SGO FRF Files is an independent shop and is not affiliated with, endorsed by or connected to Volkswagen AG, its brands, Ross-Tech or any other vehicle manufacturer or tool maker.

Privacy

How we handle your personal information is explained in our Privacy Policy, which forms part of these terms.

Changes and termination

We may change these terms from time to time. The date at the top shows when they last changed, and the version in force when you place an order applies to that order. Continuing to use the site after a change means you accept the new terms.

We may stop offering the site, or any part of it, at any time. If we do, we will give account holders reasonable notice so that they can download the files they have bought.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute about them, without taking away any protection you have as a consumer in the country you live in. If any part of these terms is found to be invalid, the rest continues to apply.
